Terms and Conditions — RespiraCare Online

1. Introduction and Agreement
RespiraCare is committed to providing a safe and reliable digital health platform. These Terms and Conditions ("Terms") outline the obligations and expectations for all users of the RespiraCare platform ("Platform").
By registering for an account or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Platform. These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth legislation including the Privacy Act 1988 (Cth) and the Health Practitioner Regulation National Law.
2. About the Platform
RespiraCare is a digital platform developed to support the management of respiratory conditions. It connects patients with their assigned clinicians and provides tools for health education, appointment management, health data tracking, and secure communication.
RespiraCare is not a healthcare provider and does not practise medicine. The Platform facilitates access to clinical services, but the clinical relationship exists solely between the patient and their assigned clinician. Content available on the Platform, including educational resources, is for general informational purposes only and does not constitute medical advice.
3. Eligibility and User Accounts
The Platform is intended for use by three types of users: patients, clinicians, and administrators.
Clinicians must hold current, unconditional registration with the Australian Health Practitioner Regulation Agency (AHPRA). Clinicians are required to submit their credentials through the Platform for administrator verification before accessing clinical features.
RespiraCare reserves the right to decline or cancel registration at its own discretion, including where inaccurate information is provided.
4. Your Account
When you register, you agree to provide accurate and complete information
and to keep it up to date. You are responsible for maintaining the
confidentiality of your login credentials and must not share them with
anyone else.
If you become aware of any unauthorised access to your account, please notify us immediately. You are responsible for all activity carried out under your account.
5. Acceptable Use
You agree to use the Platform lawfully and in good faith. You must not:
- Submit false or misleading information, including health data or credentials.
- Attempt to access another user’s account or data without authorisation.
- Upload or transmit harmful, harassing, or unlawful content through any Platform feature.
- Interfere with or disrupt the operation of the Platform.
RespiraCare reserves the right to remove content that breaches these requirements and to suspend or terminate accounts where misuse is identified.
6. Clinical Responsibilities
Appointments and communications through the Platform are subject to the same professional standards as in-person care. Clinicians are responsible for practising within their scope of competence, disclosing the limitations of remote care to patients, and recommending in-person review when clinically appropriate.
Health data submitted by patients is accessible to their assigned clinician for monitoring purposes. Any automated notifications generated from that data are a support tool only — they do not constitute a clinical diagnosis and must not be treated as a substitute for professional assessment. If you believe your condition is worsening, seek in-person care or call 000.
The Platform’s messaging feature is for non-urgent communication only and must not be used in an emergency. Clinician response times are not guaranteed.
7. Privacy and Personal Information
RespiraCare collects and manages your personal and health information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our Privacy Policy sets out in full how we collect, use, store, and protect your information and forms part of these Terms.
8. Intellectual Property
All content, software, and materials on the Platform are owned by or licensed to RespiraCare. You are granted a limited licence to use the Platform for its intended purposes only. You must not reproduce, modify, or redistribute Platform content without prior written permission.
Health data and records you submit through the Platform remain yours. By submitting them, you grant RespiraCare a limited licence to process that information solely to deliver the Platform’s services.
9. Disclaimers and Liability
The Platform is provided on an "as is" and "as available" basis. While we take reasonable steps to ensure the Platform is reliable and accurate, we do not warrant uninterrupted or error-free access. RespiraCare may amend, suspend, or withdraw features at any time.
RespiraCare is not liable for clinical decisions made by clinicians using the Platform, or for any loss arising from reliance on Platform content in place of professional advice. To the extent permitted by the Australian Consumer Law (ACL), RespiraCare excludes liability for indirect or consequential loss. Nothing in these Terms excludes rights that cannot be excluded under the ACL.
10. Changes to These Terms
These Terms may be updated from time to time. Where significant changes are made, registered users will be notified. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
